These Terms of Service ("Terms") govern your use of Prometheus CI ("Service"), operated by Prometheus ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Prometheus CI is an AI-native competitive intelligence platform that monitors competitor activity, generates strategy briefs, creates battlecards, and provides AI-powered competitive analysis through our Argus assistant. The Service includes web-based dashboards, API access, and integrations with third-party tools.
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must provide accurate, current, and complete information during registration. You must promptly update your account information if it changes.
You may not share your account credentials or allow others to access your account. Each team member must have their own account within your organization's plan.
Free Trial. All plans include a 14-day free trial. No credit card is required to start a trial. You will not be charged unless you actively choose to subscribe after the trial period ends.
Monthly Billing. Subscriptions are billed monthly in advance. Your billing cycle starts on the date you subscribe to a paid plan.
Plan Changes. You may upgrade your plan at any time, and the change will take effect immediately with prorated billing. Downgrades take effect at the start of your next billing cycle.
Refunds. If you are unsatisfied with the Service, you may cancel within the first 30 days of your initial paid subscription for a full refund. After 30 days, no refunds are provided for partial billing periods. You may cancel at any time and retain access through the end of your current billing cycle.

Our IP. The Service, including its design, code, algorithms, AI models, and documentation, is owned by Prometheus and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Your Data. You retain ownership of all data you input into the Service ("Customer Data"). You grant us a limited license to use your Customer Data solely to provide and improve the Service. We will not sell your Customer Data or use it to train general-purpose AI models.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.
THE COMPANY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO THE COMPANY DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
You may terminate your account at any time by canceling your subscription through the Service settings. Upon cancellation, you retain access through the end of your current billing cycle.
We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users. In cases of suspension or termination for cause, we are not obligated to provide a refund.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
